Notice regarding Nicromet calls

Pursuant to Article 13 sec. 1 and sec. 2 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter the “GDPR”, please be advised that:

1. The Controller of your personal data provided by you during the telephone call and your telephone number is Nicromet Spółka z ograniczoną odpowiedzialnością Spółka komandytowa with its registered office in Bestwinka, ul. Witosa 28, 43-512 Bestwinka.

2. Call recording is used to improve the standard of Nicromet’s service and to ensure accountability of Nicromet’s activities.

3. Call monitoring covers incoming and outgoing calls from the Controller’s company to telephone numbers not belonging to the Controller.

The legal basis for the processing of personal data is Art. 6 sec. 1 (a) of the GDPR – the consent of the telephone caller given by continuing the conversation after the audio recording message.

5. If the caller does not agree to the recording, they may disconnect and use other available channels of communication with the Controller.

6. Recordings are kept for a period not exceeding 3 months from the date of the call.

7. Where the recordings constitute evidence in proceedings under the law or the Controller has become aware that they may constitute evidence in the proceedings, the time limit is extended until the proceedings have become final. To the extent that the recordings include recorded declarations of intent (e.g. submission of complaints, granting of additional consents, etc.), they may be stored, despite even the caller’s withdrawal of consent, based on the premise of the Controller’s legitimate interest on the basis of Article 6 sec. 1 (f) of the GDPR, consisting in this case of the need to preserve evidence as to the legal effects of the declarations of knowledge and intent on the Controller for the purpose of demonstrating the lawfulness of the Controller’s actions or the assertion of claims.

8. Providing any information during a call with the Controller is voluntary, but disconnection or refusal to provide information may prevent the Controller from taking the action expected by the caller.

9. The recorded telephone calls shall only be made available to persons and authorities authorised to do so, in particular providers of telecommunications solutions enabling the recording and archiving of data and law firms.

10. Your personal data shall not be transferred to a third party/international organisation. No automated decisions are taken against you based on the data recorded.

11. With regard to the processing of your personal data, you have the following rights:

  • right to access your personal data;
  • right to rectification of your personal data, insofar as the requests are not manifestly impossible to carry out due to technical constraints and are not limited or precluded by other legislation.
  • right to erasure in the situations referred to in Art. 17 sec. 1 of the GDPR subject to Art. 17 sec. 3 of the GDPR;
  • right to restrict the processing of the data;
  • right to object to the processing, insofar as they are not demonstrably impossible to carry out due to technical limitations and are not limited or excluded by other legislation;
  • right to withdraw consent to processing, without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal.

12. The request to exercise the above rights shall be made to the Controller’s registered address indicated above or through the electronic communication channels indicated on the Controller’s website www.nicromet.pl.

13. If you consider that the processing of your personal data is unlawful, you have the right to lodge a complaint with the supervisory authority, which is:
